8 Things Fathers Should Consider To Win The Divorce & Custody

At the time of divorce, a father can win the custody of their children by being reasonable, hiring a good attorney, and getting good references from others.

Problems in marriages can lead to divorce and later lead to couples fighting over the rights of their children. Sometimes these fights can become very aggressive and the court will give the rights to the one they think is best for the children but may fail to realize who is right for the child.

This becomes even more true if you are a father. If both the father and mother stand on equal grounds, the mother still may be preferred by the court. But there are plenty of ways for you to turn the tides in your favor.

Here are a few things you should do to protect your rights as a father in a divorce and custody.

1. Hire A Reputable Attorney

For dealing with creative and clever spouses, you need to have an equally clever attorney. These smart attorneys have huge experience in this field and know how to get inside the mind of these narcissistic parents and bring out their true faces from within. 

This gives you an almost guaranteed chance of winning the custody battle of your children. But while selecting an attorney, be sure to select an experienced attorney who has been doing such work for a long time. You can find these experienced attorneys in Mens Legal Center. 

These deceptive spouses can even go to such an extent that they will file fake allegations of abuse, threat, harassment against the father. This may even cause further interrogation, the father should only respond to personal information and not admit to any allegations without the attorney.

2. Always Remain Composed

As a father, you must be cool, calm, and collected if you are to win the rights of your children.

You need to be patient while fighting for your rights. Many fathers become aggressive and often yell or shout at their spouse in court. This puts a lot of negative impact on them as the court will favor the one who remains calm and cool under extreme pressure.

3. Be Rational At Every Stage

Another factor most fathers fail is when their spouses turn very creative, persuasive, narcissistic, and cunning, they often make the court go against the favor of the father.

So, to make sure that the father wins the custody battle over his children, he needs to be very careful of what he says. Under no circumstances must he raise his voice or yell at the mother. He must be very reasonable with the other parent.

If he feels that the other party has done something wrong and is angered by her action, he must not let emotions take hold of him but instead, think everything thoroughly. His emotions should not control his thoughts when creating a parenting plan. 

If the father lets emotions take hold of him, the conversation might get heated. This leaves a lot of room for the other parent to accuse the father of verbal assault.

Therefore, keeping a cool temper throughout the whole process is absolutely necessary. It is a game of nerve and he who breaks first will lose the right. This might cause the children to grow up in an environment that will hinder their mental health. 

4. Be Cooperative

The father can initiate a conversation before the whole fight in the courtroom. The father should sit with the other parent and try to negotiate about the custody of the children and discuss who should have them and what will be the most beneficial for the children. 

Negotiating with the mother will make things a lot easier than arguing back and forth in court.

Being cooperative and calm will also help you get back on your feet after the complete separation. Newly single dads have to be comfortable and confident in their abilities to move forward.

5. Attend The Court

The fathers often make the mistake of not showing up in the court with some excuses. This puts a huge strain on their responsibility trait while making the other parent a more viable choice for the court.

6. Use Earning As A Weapon

In some cases, the fathers have a better bank balance than the mothers and make more money per month. The fathers can use this in their favor and if the court takes this into account, the fathers will have a bigger chance of winning.

7. Have A Good Character Reference

The court will often time look into the background of both the parents. They will ask the neighbors, relatives, workplace, and people who know them well.

If the father has more people saying good things about him, the judge will take these references and give the verdict towards the father.

8. Plan On Getting Married Again

Getting remarried makes the judges think that the father is serious about the family and will put big effort towards raising the children.

Of course, the saying of the new spouse will also be taken into consideration, but if everything goes well, the court will make the remarried father a more valid choice.

Winning over the rights of children is a long and stressful procedure that puts a lot of strain on the nerve of any parent. So if the fathers can resist and bite the stress back with complete patience and calmness, they can easily win the favor of the court and the custody of the children.
